Section §2116-a(3) of NYS Education Law and Section §170.12(e)(1) of the Regulations of the Commissioner of Education require all BOCES and each school district employing eight or more teachers to obtain an annual
audit of its records.

Audit Reports

School districts, charter schools, BOCES and most local governments have specific filing and/or notification responsibilities as set forth in General Municipal Law (GML):

Section 35 of GML requires the clerk to file and provide public notification of an issued audit report and includes a sample publication notice and certification.
Section 33 of GML requires school districts, BOCES and charter schools to post the final audit report on their website, if available, or otherwise make the audit report available for a period of at least five years. Other local governments are encouraged to follow this requirement as well.
